MEMPHIS, Tenn. (WMC) – Increased oversight of the Memphis Police Department (MPD) is on the horizon following recent federal findings of civil rights violations.
Two weeks after the U.S. Department of Justice (DOJ) concluded its 17-month investigation, which held the city and MPD accountable for multiple federal civil rights violations, city officials have unveiled their next steps.
The DOJ’s investigation revealed significant issues within MPD, including excessive use of force, unlawful stops, searches, and arrests, as well as discriminatory enforcement against Black residents. Additionally, the DOJ found that the MPD discriminates in its response to individuals with behavioral health disabilities.
While declining to enter a consent decree with the DOJ, Memphis Mayor Paul Young cited the financial burden experienced by other cities as a key concern.
“The consent decree in Chicago has cost their city more than $500 million,” said Mayor Young. “The consent decree in Seattle has cost their city more than $200 million.”
Appointing Judge Bernice Donald for Oversight
Instead of a consent decree, the city announced that former federal Judge Bernice Donald will lead the oversight process.
Judge Donald, the first African American woman to serve on the U.S. Court of Appeals for the Sixth Circuit, retired in January 2023. She will now take on the role of a “neutral and independent monitor,” guiding Memphis’ community response and action plan.
The city outlined Judge Donald’s responsibilities, which include overseeing a nine-member task force designed to coordinate community engagement and develop a response plan.
Community Engagement and DOJ Involvement
The DOJ remains involved in Memphis, with officials gathering input from residents on necessary improvements to the police department.
Mayor Young expressed optimism about the collaboration with Judge Donald:
“We are encouraged to collaborate with Judge Donald on this effort; I believe there is no one more qualified to lead the process. We are committed to fostering a transparent and effective community response and believe this task force will ensure that every voice is heard. Together, we will develop a comprehensive action plan that meets the needs of our residents.”
City of Memphis Chief Legal Officer Tannera Gibson echoed this sentiment, emphasizing the city’s dedication to addressing residents’ concerns through transparency and collaboration.

While the city has announced the appointment of Judge Donald and outlined the task force’s mission, financial specifics, including Judge Donald’s compensation and the overall budget for the plan, remain undisclosed.
