The International Criminal Court (ICC) made history on Thursday, November 21, by issuing arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas military commander Mohammed Deif. The warrants, addressing war crimes and crimes against humanity, mark the first time senior officials from a Western-allied nation have faced such charges in the court’s 22-year history.

This significant decision was delivered by Pre-Trial Chamber I, a panel of three judges, including Judge Reine Alapini-Gansou of Benin, whose extensive career and expertise have made her a pivotal figure in international justice.

Judge Reine Alapini-Gansou: A Champion of Human Rights

Judge Alapini-Gansou, the second vice president of the ICC, played a central role in the panel that issued the arrest warrants. Alapini-Gansou was admitted to the Benin Bar in 1986. She worked for the Association Avocats Sans Frontières (ASF) Belgium on the project “Justice for all in Rwanda” in 2001. She is also a member of the International Criminal Bar. Alapini-Gansou was appointed to the ICC in March 2018, she has a long-standing reputation as a defender of human rights, having served as chair of the African Commission on Human and Peoples’ Rights from 2009 to 2012. During this period, she also acted as the special rapporteur on the situation of human rights defenders in Africa, a position she held from 2005 to 2009 and again from 2012 to 2017.

Her influence extends beyond the ICC. In 2011, she was appointed as a judge at the Permanent Court of Arbitration in The Hague, the oldest international court in the world. Her legal acumen has been instrumental in numerous cases, including those involving the Democratic Republic of the Congo, Libya, Mali, Myanmar, and Belarus.

In March 2023, Judge Alapini-Gansou was part of the ICC chamber that issued an arrest warrant for Russian President Vladimir Putin, citing alleged war crimes in Ukraine. This bold decision led to a retaliatory order by a Moscow court for her arrest in absentia, underscoring her commitment to justice even in the face of political pressures.

Landmark ICC Decision Amidst Challenges

The ICC’s decision to issue arrest warrants against Israeli officials followed months of delay, reportedly due to political pressures from Israel and the United States, both of which have challenged the court’s jurisdiction. Despite these challenges, Judge Alapini-Gansou and her colleagues proceeded with the case, underscoring their resolve to uphold international law.

An Esteemed Career in Justice

Judge Alapini-Gansou’s work reflects her dedication to equity and accountability on a global scale. Her contributions to the ICC, combined with her leadership in African human rights institutions, highlight her role as a trailblazer in the field. As the ICC continues its pursuit of justice in complex and high-profile cases, figures like Judge Reine Alapini-Gansou remain central to its mission.
